Since 2000, the OHS laws in NSW have been particularly bad, working against work safety and creating significant injustices in NSW.
Why High Court said the NSW laws were wrong and unconstitutional (The Kirk case):
ABC Stateline TV Debate on the NSW laws.
Why NSW ALP politicians wanted to retain the laws.
But the O’Farrell Government is rebuilding justice in New South Wales. It has changed the current OHS laws, removing the oppression and injustice embedded in the current legislation. It is applying presumption of innocence, and moving prosecutions to the normal criminal courts where appeals are allowed.
